South Africa Series: UK / SA Cross Border Estate Planning

PCD is excited to launch a new South Africa series, which will provide monthly content for international advisors to HNW clients. The first episode will cover UK / South Africa cross border estate planning, discussing the traps and opportunities that families can utilise to preserve wealth. It will look at the tax and legal treatment of assets where assets & family members are spread between South Africa and the UK. It will explain how offshore centres like Jersey can play a role in a family's wealth planning with leading experts from the field.

The discussion will feature:

Dean Douglas - Director of Private Wealth, IQ-EQ, Jersey. As well as being an executive board member of the Jersey business, Dean manages a diverse client portfolio. In doing so, he travels to South Africa and Nigeria on a regular basis to meet with new and existing clients in these two countries. Being from South Africa himself, he has an affinity with the continent and an understanding of the cultures, issues and concerns faced by residents and investors alike.

Dean's focus on South Africa and Nigeria has resulted in him working very closely with relevant industry bodies and intermediary partners. He has presented at numerous events in collaboration with Jersey Finance, including presentations in Lagos in 2017 and 2019 focused on UHNW family wealth structuring and succession planning. He has also participated in and spoken at a range of other industry events including the PCD Club networking dinner in Cape Town in 2018 and 2019. In addition, with Dean's involvement, IQ-EQ is a member of Invest Africa, a large investor network focused on Africa and investment in the continent. Since joining the IQ-EQ group 17 years ago as a newly qualified accountant, he has held various positions while gaining significant exposure to private wealth structuring from both an accounting and an administration perspective. Dean is a fellow of the Association of Chartered Certified Accountants (ACCA) and a member of the Society of Trust and Estate Practitioners (STEP).

Dr Albertus Marais - Director: Disputes, AJM Tax, Cape Town, South Africa. Previously the Head of Tax of the Wiese Family's Titan Group, and earlier part of PwC Tax, Dr Albertus Marais specialises in corporate and international tax related disputes. He holds the BAcc.LLB and LLD degrees from Stellenbosch University, the Advanced Certificate in Taxation (cum laude) from the University of Pretoria and the University of Cape Town's PGDA and MCom (Tax). He is an advocate of the High Court of South Africa, a Chartered Accountant (SA), lectures at Stellenbosch University, and is a Master Tax Practitioner with the South African Institute of Tax Professionals.

As tax consultant he considers it important to remain academically involved and in pursuance of this Albertus regularly publishes articles in academic journals. He also lectures at Stellenbosch University's MAcc (Tax) course in corporate restructures and tax avoidance while also reviewing dissertations for the University of Cape Town. Albertus is the inaugural chair of the "Young IFA Network" in South Africa, a role which he assumes within the broader "International Fiscal Association" (IFA). He also acts as peer reviewer for the De Jure and Stellenbosch Law Review publications and is the treasurer for the SA Children's Home.

Catherine de Maid - Partner, Tax, Trust & Family Department, Burges Salmon LLP, Bristol and London. Catherine is a Partner in the firm's 40 lawyer strong Tax and Private Client Team. She specialises in international tax and trusts, non-domiciliary tax planning, advising trustees on their UK tax and reporting obligations, advising trustees on risk areas including fiduciary, tax, compliance and reputational risk and philanthropy.

Catherine specialises in international tax, trusts and estate planning advice for a wide range of clients, from high net worth individuals to leading private banks and other financial institutions. She has a particular focus on advising clients with a South African connection, having worked in South Africa for 12 years where she specialised in the establishment of offshore structures for South African individuals and companies, and the establishment and running of private charitable foundations.

Rehma Imrith - Commercial Director, IQ-EQ, Mauritius. Rehma Imrith holds a Masters of Law (Financial Services Law) from the University of London and a BA (Hons) Law and Management from the University of Mauritius. She is an Associate of the Institute of Chartered Secretaries and Administrators (UK). She is also a Member of the Society of Trust and Estate Practitioners (UK) and of the Mauritius Institute of Directors.

Rehma has held various positions in the Global Business sector and has been involved in the areas of business development, product development and structuring, setting up and administration of Global Business and foreign entities, Mauritius and foreign trusts and specialist products such as pension and external insurance business. She joined the Research & Product Development Department at Cim Global Business (now IQ-EQ Mauritius) in 2010, before heading the Trust Department. She then moved to the Professional Services Outsourcing (PSO) unit, with particular focus on trust and fund accounting and back-office outsourcing as well as FATCA/CRS compliance and reporting services to trust/fund companies and family offices in high cost domiciles.

She currently is the Commercial Director, with responsibility to lead the Private Wealth segment and director of PSO at IQ-EQ Mauritius. She acts as director on several Global Business and foreign companies. She also acts as an individual trustee on a Mauritius-based pension trust and is a member of the Country Management Team at IQ-EQ Mauritius. She is the vice-chairperson of STEP Mauritius.
